{"id":1127,"date":"2017-09-13T00:29:32","date_gmt":"2017-09-13T00:29:32","guid":{"rendered":"http:\/\/www.imadscotlandgroup.com\/media\/?p=1127"},"modified":"2017-10-01T00:31:02","modified_gmt":"2017-10-01T00:31:02","slug":"holyrood-stands-to-lose-111-powers-if-repeal-bill-passed","status":"publish","type":"post","link":"https:\/\/www.imadscotlandgroup.com\/media\/holyrood-stands-to-lose-111-powers-if-repeal-bill-passed\/","title":{"rendered":"Holyrood \u2018stands to lose 111 powers\u2019 if Repeal Bill passed"},"content":{"rendered":"<p><strong>Scottish Government says devolution must be defended.  <\/strong> <\/p>\n<blockquote class=\"twitter-tweet\" data-lang=\"en-gb\">\n<p lang=\"en\" dir=\"ltr\">Holyrood \u2018stands to lose 111 powers\u2019 if Repeal Bill passed, says Mike Russell <a href=\"https:\/\/t.co\/1Xh2QXp0s7\">https:\/\/t.co\/1Xh2QXp0s7<\/a> <a href=\"https:\/\/t.co\/vSAYekCxIC\">pic.twitter.com\/vSAYekCxIC<\/a><\/p>\n<p>&mdash; The Scotsman (@TheScotsman) <a href=\"https:\/\/twitter.com\/TheScotsman\/status\/907581309186445313\">12 September 2017<\/a><\/p><\/blockquote>\n<p> <script async src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The Scottish Government cannot recommend the Scottish Parliament give its consent to the EU (Withdrawal) Bill in its current form, the Minister for UK Negotiations on Scotland&#8217;s Place in Europe Michael Russell has told MSPs.<\/p>\n<p>In a statement at Holyrood, Mr Russell set out the Government\u2019s opposition to the Bill\u2019s proposals to transfer responsibility for all EU law to Westminster, even for devolved matters.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/scottishpoliticsnews.org\/wp-content\/uploads\/2017\/09\/DJoB2HVXUAA0kbj.jpg\" alt=\"\" width=\"1096\" height=\"758\" class=\"alignnone size-full wp-image-997\" \/><\/p>\n<p>He explained that this would mean the Scottish Parliament would have no say on changes to existing EU laws in areas including agriculture, fisheries, justice, forestry or research.<\/p>\n<p>Mr Russell confirmed that a series of amendments, jointly agreed with the Welsh Government, will be published shortly. He also said that if no agreement is reached on the content of the Bill, Scottish Ministers will consider other available options for legislation in the Scottish Parliament to prepare devolved laws for the impact of EU withdrawal.<\/p>\n<p>Pointing out that that the devolution settlement is based on the principle that policy areas are devolved unless they are specifically reserved in the Scotland Act, Mr Russell said:<\/p>\n<p>\u201cThe EU (Withdrawal) Bill appears to represent a deliberate decision by the UK Government to use the process of Brexit as cover for taking powers in areas of policy which are clearly within the responsibility of this Parliament.<\/p>\n<p>\u201cIn areas of Scottish devolved responsibility vital to the success of our country, such as agriculture, the environment, fisheries, forestry, research, or justice cooperation, the Scottish Parliament will have no say over what comes back from the EU on withdrawal or what is done with these important policy areas afterwards. <\/p>\n<p>\u201cIt is not a logical, or essential, part of any Withdrawal Bill that new limitations are placed on the Scottish Parliament\u2019s powers, on the National Assembly for Wales\u2019s powers, or on the powers of the Northern Ireland Assembly.\u201d<\/p>\n<p> <script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><br \/>\n<!-- responsive1 --><br \/>\n<ins class=\"adsbygoogle\" style=\"display: block;\" data-ad-slot=\"3379014842\" data-ad-client=\"ca-pub-8934562929349122\" data-ad-format=\"auto\"><\/ins><br \/>\n<script>\n(adsbygoogle = window.adsbygoogle || []).push({});\n<\/script> <\/p>\n<p>Mr Russell added:<\/p>\n<p>\u201cThis is not a debate about whether we should leave the European Union.  The position of this government and indeed the position of the people of Scotland expressed in last year\u2019s referendum is clear on that matter.  We don\u2019t want to leave.\u201d<\/p>\n<p>But, he said:  \u201cWe  have frequently made it clear that, despite our wish to maintain EU membership, we recognise our obligation to prepare Scotland as best we can for what might transpire. Indeed Brexit is going to be such a dramatic, damaging upheaval to the UK\u2019s legal systems and to our laws that it is imperative that we do everything we can to prepare responsibly for the consequences of EU withdrawal.   <\/p>\n<p>\u201cThe only appropriate way to divide powers between the governments is this: powers in relation to policy areas which are devolved must be for devolved ministers and devolved legislatures.
